Foreign nationals living in the UK, who have committed a criminal offence in the UK which carries with it a custodial sentence, may be issued with a deportation order.

All custodial sentences of more than 1 year could lead to an automatic deportation order being made. A person given a sentence of less than 1 year could be subject to a deportation order if it is argued that it is in the public interest for a deportation order to be made against them.

It may be possible to appeal and overturn a deportation order if it can be shown that there are compelling human rights grounds for the person subjected to the deportation order to remain living in the UK.
