About the Department

The Department straddles both domestic public law challenges and public international law. We are regularly sought and instructed by a range of clients, from States to non-governmental organisations to the most vulnerable individuals in society.

In a domestic context, we regularly litigate high profile and precedent setting cases, focusing on a broad range of areas. We are often sought for our expertise in judicial reviews, international law in a domestic context, protest rights, data protection and freedom of information, counter-terrorism and human rights and for our experience in false imprisonment claims. The case load can be extremely varied. For instance, we have recently brought challenges to the grant of immunity to foreign dignitaries, have positively reformed the immigration detention system through our litigation, successfully challenged disproportionate counter-terrorism measures, brought the first judicial review challenge to the press regulators, secured rights for victims of trafficking and brought a number of challenges against the British government for involvement in torture overseas.

In our international practice, we advise and represent States and private entities on a wide range of contentious and non-contentious public international law issues. Recent highlights of our practice include advising and litigating before the International Criminal Court, advising states and non-state actors on statehood and human rights issues, advising individuals in respect of INTERPOL notices, advising individuals subject to international and regional sanctions, litigating the grant of export controls licences and conducting an international fact finding inquiry to draft a high-profile report into human rights violations in a state. 

Overall purpose for this role

  • To conduct cases on behalf of the Public Law Department.
  • To assist with the continued development of the Department.
  • To assist the firm in achieving its professional and commercial objectives. You will ideally have a good network of contacts within the field, including contacts with referral agencies.

Main duties and responsibilities

  • Dealing effectively with enquiries, to assess the merits of the claim and determine whether it falls within the department’s competence;
  • Taking instructions from new clients and advising them of the costs associated with the claim and the various funding methods. This includes funding applications to the LAA, through the CCMS system where necessary. You will be expected to have detailed knowledge of the LAA scheme and its operation.
  • Liaising with all parties to a claim, whether with a Defendant, Court, Registry, Tribunal or other body and any other party and/or their solicitors of the firm's interest.
  • Providing detailed, high quality advice to the client in the appropriate areas of law, in clear and understandable language. 
  • Undertaking all necessary preparation of the case or matter, including, where necessary, instructing counsel, assisting with the preparation and drafting of pleadings, preparing documents for disclosure, taking the client's proof(s) of evidence, proofs of witnesses including expert witnesses, obtaining and perusal of all necessary documents, preparing and delivering instructions to experts where appropriate, attending or arranging attendance at conferences, consultations, or hearings, confirming with the requirements of the CPR or other applicable rules of procedure;
  • Maintaining all necessary correspondence in good order in paper and electronic files.
  • At all times, having strict regard to the Solicitors Regulation Authority's Standards of Professional Conduct and Ethics, and in particular to the strict requirement of confidentiality of clients' affairs.

Person Specification

Essential

  • Ideally suit qualified lawyers up to 3 years’ relevant post qualification experience in civil litigation, public and /or private law.
  • A thorough and comprehensive understanding of Human Rights / judicial review practice.
  • Relevant experience in public and / or human rights law and / or international law.
  • Experience and knowledge of data protection framework and related regulations.
  • Experience working on publicly funded cases.
  • Proven experience in conduct of cases from initial advice through to trial.
  • Experience of working with vulnerable clients.
  • Genuine interest to work in a public law / public international law practice.
  • Keen about providing access to justice to all.
  • Proficient drafting skills, including the ability to draft persuasive representations and letters before claim, statements of case (when appropriate), witness statements and other documents.
  • Proven ability to make sound strategic decisions when advising and during litigation to achieve the best results for clients whether in settlements or at trial.
  • Demonstrable ability to research, analyse and evaluate complex fact patterns, legal concepts and related issues.
  • Experience in sorting and reviewing evidence.
  • Experience in dealing sensitively with clients and experts, providing solutions and managing difficult situations and conversations.
  • Solid experience in using a variety of IT packages (MS Word, Excel, Case Management Systems and Outlook).
  • Excellent communication skills, demonstrated by ability to communicate accurately, clearly and concisely, both verbally and in writing.
  • Excellent time management skills, demonstrated by ability to organise and prioritise a complex workload and work to tight deadlines.
  • To assist the firm in maximising income and profitability by effective time recording, billing and staff planning.
  • Proven experience with the administration arising from the case conclusion, whether it is inter partes costs, CFA funded costs, legal aid only or some other form of funding through to payment of damages and clearing off of financial legers to archiving of files.
  • Substantial experience in working and contributing in a team environment.

Desirable

  • An existing case load to be able to bring to the firm.
  • Interest in and ability to develop links with potential referral organisations.
  • An interest in developing the practice areas by writing, lecturing and networking through a variety of forums is necessary.
  • Proven ability to delegate appropriately and to supervise and motivate reporting staff.
